01 Acceptance
By installing or using Pixel Dust ("the app", "the software") you agree to these Terms. If you don't agree, uninstall the app.
02 License
We grant you a personal, non-transferable, revocable license to use the app on your own macOS devices for personal or professional purposes. You may not redistribute, reverse-engineer, or sublicense the app.
03 Private beta nature of the software
Pixel Dust is in private beta. It may:
- Crash, corrupt, or fail to capture moments.
- Require manual database migration when you update.
- Change features significantly between versions.
- Be taken offline for maintenance without notice.
Back up important data independently. We are not liable for data loss during the private beta period.
04 What you may not do
You agree not to use the app to:
- Record screens you do not own or have permission to record.
- Capture other people's data without their informed consent.
- Violate any applicable privacy law in your jurisdiction.
- Attempt to extract, copy, or redistribute the app's model weights or database encryption keys.
You are solely responsible for ensuring your use of screen-capture software complies with local law, your employer's policies, and the terms of any software you capture.
05 Disclaimer of warranties
The app is provided "as is" without warranty of any kind. We make no guarantee that it will be available, error-free, or fit for any particular purpose. Use it at your own risk.
06 Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to data loss, business interruption, or loss of profits.
07 Privacy
How we handle data is described in our Privacy Policy, which is incorporated into these Terms by reference.
08 Changes to terms
We may update these Terms at any time. The "Last updated" date will reflect any revision. Continued use of the app after a change constitutes acceptance.
09 Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles.
Nothing in this section removes any protection you have under the mandatory consumer protection laws of the place where you live. If you are a consumer, you keep the rights those laws give you regardless of the choice of law above.
